What the law says, in short
- The company is liable for defects that show up within 3 years of delivery; if it installed the window, the count starts when the installation ends (articles 11 and 12 of Decree-Law 84/2021).
- In the first 2 years the defect is presumed to have existed; after that the consumer must prove it (article 13).
- You can choose between repair and replacement, free. Price reduction and cancelling only if the company failed, refused or the defect is serious, or in the first 30 days (articles 15, 16 and 18).
- Notice must be by letter, email or another means that leaves proof (article 12(5)). Your rights lapse 2 years after the notice (article 17).
